In accordance with the Portuguese Law, a requirement to obtain a temporary residence permit (being D7 Visa one of them) is not having been convicted for a crime punished in Portugal with prison for more than one year. Nonetheless, there is the possibility to request from local authorities the removal of the criminal information from the record due to the time passed since the criminal event, which is advisable.

Obtaining a residence permit in Portugal with a criminal record largely depends on the nature of the offense and how it is penalized in Portugal. In Portugal, if the sentence for the offense is longer than a year, the residence permit can’t be granted.

According to the Portuguese law, a residence permit can only be granted to those who can prove the absence of conviction for a crime that, in Portugal, is punishable by a custodial sentence lasting more than one year.
