Can I apply for a Australia investor visa after I get my MBA?

Hi! I'm Argentinean looking to study an MBA in Australia and thinking about applying for a permanent residency visa after I get my degree. I want to set up a business there and apply for an investor visa. Is that possible?

It would depend on your investment background/business type and available net financial assets on hand at the point of application; it would also depend on which stream of investor visa you are applying for, as the eligibility criteria hinge on a number of factors. At the moment, the direction of the investment visas under subclass 188 is also uncertain. No quota has been allocated for this visa type until further notice. To be updated, you are encouraged to follow the news after 1 July 2024 and to get in touch with a migration professional regarding your visa pathway.

No, you can no longer apply for the 188 Investor visa. It is closed. However, you can apply for a Student visa to study your MBA, in Australia, and on graduation, you may be eligible for the Temporary Graduate, 485 visa. Also, you may be eligible for Skilled migration, depending on your skilled occupation and points score.

At this time there are no investor visas available for Australia. Under the new migration strategy, the business and investment program is under review. There are strong indications we will have a new version of the Significant Investor Visa (which previously required A$5m to be invested in various fund solutions), but I would not expect this until late 2025 or later. There will unlikely be any business-owner-based pathways (previously called "business innovation"). The likely pathway for you would be to apply for a subclass 485 post study work visa - this is provided your study is at least 2 years in Australia, and you're under 35 (if you apply before this new age limit will be introduced). If you're not eligible for this then consider the working and holiday  visa (subclass 462) for Argentinians under 31 years of age. Note that you will need at least 2 years of work experience in the occupation being nominated for a subclass 482 work visa, and at least 3 years for a subclass 494 regional work visa. You should also explore your eligibility for the general skilled pathways - subclass 189, 190, and 491.

The Business visa program is currently under review in Australia. It is not known yet what will be available in a few years after you finish your degree. We may know more after July. Generally, an Investor visa does not involve running or owning a business, but instead, you need to invest an amount of money for a period of time according to the legislative requirements.

Yes, it is possible. However, during your student visa period, even if you work for your own business, you should comply with the number of hours of work limitation imposed on the Student visa.  Further, Investor visas are presently not allocated and are under review for changes. Therefore you need to meet the regulations at the time of your completion of the course.

The Australian business innovation and investment visas have been closed, and no more applicants can apply for these visas. All state nominations for these visas have been exhausted, and no new nominations will be accepted until the end of this financial year (July 2024).
