How can I postpone my skilled migrant visa renewal in Australia while transitioning to a new job opportunity?

I’ve been on a temporary skilled migrant visa in Australia for the past 4 years working in the fintech industry. I’ve just lost my job with the renewal date coming up but there’s another job offer I’m anticipating. So I’m wondering if there’s a way I could postpone the renewal date or inform them of the job offer I’m waiting for so I can continue to live here legally until I can renew the visa?

To continue to stay lawfully in the country, you need to lodge a new visa application before the expiry of your current visa. The 408 visa is a useful visa category for clients who are in between sponsors, or perhaps the labour market testing is not complete in time for lodgement. During the Covid pandemic, the government introduced a "Covid" stream under the Australian Government Endorsed Events, naming the pandemic as an endorsed event in a legislative instrument. As there is no end date that has been set for the pandemic, this is still an available option, and one that I recommend to clients in this situation. The 408 visas are still being granted with work rights for a period of one year which gives the applicant more time to apply for another visa.

If you have an incentive to return to Australia then you can file your RRV any time, so you need to discuss with a migration agent to see what incentives you have which satisfy the RRV requirements.

Holders of temporary skilled migrant visa in Australia are permitted to work in Australia only in the occupation they were nominated for and only for their nominating business. This is a temporary visa. Holders can stay in Australia for the period of time their employer nominates them for. You can’t stay longer by extending the visa. Extensions are provided only for visa holders who were affected by the Covid-19 related restrictions. Therefore, if your visa is expiring and you want to keep working in Australia, your employer will need to submit a new nomination and you must apply for a new visa.
